Regulating AI: Where U.S. State Policy and HCI (Mis)align
Artificial intelligence (AI) technologies are increasingly adopted into everyday life, with most investment and development concentrated in the U.S. In response to rapid AI integration and scant federal guidelines, U.S. states have formed AI committees charged with studying AI-related societal trade-offs. We analyzed the 18 existing state-level AI committee reports to understand how policymakers discuss AI-related benefits and risks. We then compared the risks surfaced by policymakers to an established taxonomy of AI risks aggregated from literature and examined how policymakers' concerns align—or misalign—from those of HCI scholars. These insights provide important mileposts for shaping currently ongoing policy initiatives and future research.

State-Level AI Policy Drivers
U.S. states are primarily motivated by three key factors in establishing AI committees and developing policy:
- Responsible Governance (83% of states): The most dominant motivation, emphasizing the need to integrate AI "safely and correctly" while maximizing benefits and minimizing risks. This often involves defining foundational governance frameworks.
- Economic Growth (61% of states): States aim to position themselves competitively in an AI-driven economy, fostering innovation, and upskilling the workforce for AI-dominated job markets.
- Government Operations (55% of states): A focus on leveraging AI to enhance government services, improve efficiency, transparency, and citizen experience, and bolster institutional capacity.
These motivations often overlap, indicating a layered approach to AI policy development, balancing the pursuit of technological advantages with a commitment to societal well-being.
AI Benefits vs. Risks Across Sectors
Our analysis revealed that across various sectors, state policymakers consistently emphasize the benefits of AI significantly more than its risks. This imbalance is highlighted in Figure 1 of the original report, with benefits often discussed in greater depth than potential harms.
Key sectors where benefits were prominently discussed include:
- Government Services: Chatbots for constituent support, legislative drafting, public sentiment analysis.
- Health: Early disease detection, drug discovery, automated patient record summaries.
- Education: AI-powered grading, virtual teaching assistants, standardized exam simulations.
- Workforce & Economy: Labor market trend prediction, tailored employment connections.
While risks like data privacy, overreliance, and job displacement were mentioned, they typically lacked the detailed discussion and proposed mitigation seen for benefits. Agriculture, for example, mentioned significant benefits but no risks.
HCI-Policy Alignment on AI Risks
While there are overlaps, state committee reports' discussions of AI risks often misalign with those emphasized by HCI researchers. Policymakers tend to discuss risks more cursorily and with less specificity, highlighting a gap in broader socio-technical concerns.

State reports often reduce complex issues like algorithmic bias to model risk assessments, overlooking broader structural inequalities. Risks related to human goals/values conflicts, cyberattacks, and loss of human agency are significantly underemphasized compared to HCI literature. Instead, states disproportionately focus on unequal performance and lack of transparency/interpretability.
Effective AI Policy Development Flow
States propose several mitigation strategies, often presented separately from specific risks. These strategies, while aligning with HCI values, frequently lack detailed operational definitions.

- AI Literacy: Improving understanding of AI for K-12 students, the public, and the workforce (e.g., "citizens AI academy," online courses).
- Inclusive Governance: Emphasizing diverse stakeholder input, public participation, and representation, particularly from underserved communities, though often limited in practice.
- Human-Centered Values: Prioritizing privacy, security, human oversight, and transparency in AI system design and deployment.
- Risk Assessments: Mandating pre-deployment and ongoing risk assessments for high-risk AI applications in both public and private sectors.
However, definitional ambiguities, especially around "AI" and "high-risk," hinder operationalization. This underscores the need for clearer terminology and stronger integration between policy and HCI research.
